1. Eligibility

You must be at least 18 years old to use the Services. By using them, you confirm that you meet this requirement and that the information you provide to us is accurate.

2. The Waitlist

Joining our waitlist registers your interest in EVERGRIT and allows us to contact you with launch updates and early-access offers. It does not create any obligation to purchase, nor any obligation on our part to supply products, offer specific pricing, or launch by any particular date. You may unsubscribe at any time.

3. AI Skin Coach

The AI Skin Coach provides general, informational guidance based on the responses you submit, generated with the assistance of a third-party AI service. It is not medical advice and is not a substitute for consultation with a qualified dermatologist or healthcare professional. Do not rely on it to diagnose or treat any skin condition. If you have a medical concern, please consult a professional. We make no guarantee as to the accuracy or suitability of the guidance for your individual circumstances.

4. Products and Purchases

EVERGRIT products are available for purchase through the Services. Product descriptions, ingredients, images, and prices are provided in good faith and may be updated without prior notice; colours and packaging may vary slightly from images shown. All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Payments are processed securely through our payment partner, Razorpay, and we may offer UPI, cards, net banking, and (where enabled) Cash on Delivery. An order is confirmed only after successful payment authorisation, or COD confirmation where applicable, and we will send order updates by email and/or WhatsApp. We reserve the right to refuse or cancel any order, including where a price has been mis-stated or an order is flagged as high-risk. All purchases are additionally governed by our Refund & Cancellation Policy and our Shipping & Delivery Policy.

5. Intellectual Property

The EVERGRIT name, logo, taglines, designs, text, graphics, and all other content on the Services are owned by or licensed to us and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Services without our prior written permission, except for personal, non-commercial use of the website as intended.

6. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorised access to our systems, data, or other users’ data.
• Interfere with, disrupt, or place undue load on the Services or their infrastructure.
• Submit false, misleading, or another person’s personal information.
• Scrape, harvest, or use automated means to extract data from the Services without permission.

7. Third-Party Services and Links

The Services rely on third-party providers (such as hosting, database, AI, and messaging platforms) and may contain links to third-party websites or services, such as our social media profiles. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms.

8. Disclaimers

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any information provided through them is complete or accurate.

9. Limitation of Liability

To the maximum extent permitted by law, EVERGRIT and Menspace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or relating to your use of (or inability to use) the Services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Indemnification

You agree to indemnify and hold harmless EVERGRIT and Menspace from any claims, damages, or expenses arising out of your misuse of the Services or your breach of these Terms.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and handle your personal data.

12. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Hyderabad, Telangana shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Services.
